Navigating Dangerous Waters: From Survival Reactivity to Receptive Creativity

with Michal Shaked and Michal Kaempfer

For Mediators, Family Law Lawyers and Collaborative Professionals

Danger automatically triggers survival mode reactions. Divorce, as one of the major traumatic life experiences, often triggers the client’s most primitive survival instincts. Moreover, through interaction with clients, the team members’ survival reaction may be triggered as well. In this interactive workshop, we will explore together the choices we make, and offer learning tools such as the “Johari Window”, self-reflection, the “BASIC PH” Model of Coping and Resiliency (Mooli Lahad) and the power of intentional thinking in order to create a strong vision for change.

Michal Kaempfer is a collaborative lawyer, mediator and trainer from Israel. She is the cofounder of the “Divorcing Peacefully” collaborative practice group (www.israeldivorce.co.il) established in 2009 and served as chairman of its managing committee for years. She served in the army in the Israeli Intelligence, was a legal adviser for Na’amat—a women’s rights organization and provided mediation services for the court system, including preliminary meetings for parties encouraging them to go through ADR process before continuing the legal process. She has taught basic and advanced mediation courses and has provided Interdisciplinary Collaborative Practice training for the Israeli Bar Association and for the Ministry of Labor and Social Affairs. She dedicates her private practice to peacemaking workshops, training and lectures.

Michal Shaked has her own law and mediation firm based in Haifa and Tel Aviv, and teaches family mediation and ADR in the faculty of law at Bar Ilan University. She is the vice-president of the Israeli Bar Association, and is chairman of the IBA’s ADR forum as well as the international forum. She is also co-founder of the “Nifradim” collaborative group (www.nifradim.co.il). She served as a legal adviser at women’s shelters and after years of litigation and negotiating high profile cases, has decided to focus on DR work, while mainly offering mediation and collaborative work. She was chief editor of the Haifa Bar Law Review and wrote a proposal for a bill to change one of the main laws to benefit victims of domestic violence.

Helping conflicting parties understand more about what each other values and how it contributes to their actions assists them to gain “insight” and seek new ways of interacting that are less threatening and more productive. When the conflict is managed effectively, parties can make better decisions and reach lasting agreement.

Building on the idea that we are more effective in our work when we can be authentic and natural, this workshop will challenge your judgments and assumptions – and help you become more curious!

As Conflict Professionals, our job is to help clients move through their difficulties and open themselves up to the many possibilities for the future. But this is not easy.

We need to be aware that we, just like our clients, are influenced by our own judgments and assumptions. In this 1 day workshop, we will explore our own judgments and assumptions and learn how to be “productively” curious. With a combination of experiential learning, and self-exploration, you will learn how to be effective in asking questions, more natural in your responses, and more authentic in your practice. We also think that playing with curiosity will help you enjoy your life more!

This is ACP Calgary’s first virtual conference and we are inviting all Canadian lawyers and professionals who work with separating families to attend. We encourage you to join us as we hear about leading-edge Canadian academic research and practice management relating to domestic violence. Collaborative Professionals will be pleased to see that we have Canadian collaborative professionals presenting on their experience with domestic violence screening and the unique opportunities and challenges that collaboration presents.

Through this program, participants will:

  • Gain insight into judicial decisions in the context of domestic violence and family law and discuss the implications for collaborative professionals
  • Recognize domestic violence and understand its impact on individuals, families, and community
  • Address personal bias around domestic violence
  • Develop comfort in responding to disclosure of domestic violence and learn how to build appropriate support and referral services
  • Utilize tools to assess and determine mitigation strategies for personal and professional risks associated with taking a file where domestic violence is a factor
  • Learn to navigate the lawyer’s professional and ethical obligations in Collaborative Practice where there is Family Violence
